Greenbrae’s Covenants, Conditions and Restrictions (CC&Rs) protect the character, safety and shared value of our neighborhood. This page explains where the CC&Rs come from, how they apply to your property, and how to obtain the recorded document for your parcel.


Background

Where the CC&Rs come from

The CC&Rs originated with the Schultz Company, which developed Greenbrae across 17 subdivisions. The CC&Rs run with the property, meaning they are attached to the land itself and bind each owner upon acquisition of a parcel. They are commonly referenced in title insurance policies. Over time, supervision of the CC&Rs was transferred from the Schultz Company to the Greenbrae Property Owners Association.

In plain language

Summary of the CC&Rs

The following is a plain-language summary. It does not replace the recorded CC&Rs for your parcel - always verify against the official document.

  1. Residential use. One single-family dwelling per lot, of recognized architecture, painted or stained at the time of erection. No commercial uses of any kind are permitted.
  2. Plan approval. Plans must be submitted in duplicate to the Association for approval before any construction, including excavation. Structures with multiple frontages receive special treatment.
  3. Accessory structures. Conservatories, greenhouses and detached garages are permitted, provided they are one story, ornamental, built of matching materials, and constructed to approved plans.
  4. Setbacks and easements. Setback and utility-easement restrictions apply. Verify against the CC&Rs and with the Marin County Planning Commission or the City of Larkspur. Setbacks are measured from the original planned curb location, not the physical curb.
  5. Trees and views. No cutting, trimming or removal of trees on public or private land is permitted without prior written Association consent. Planted trees may not be allowed to grow in a way that blocks views.

    Yes. The CC&Rs run with the property and bind each owner upon acquisition of a Greenbrae parcel.

  • Where do I get the CC&Rs for my parcel?

    Contact the Marin County Recorder at the Civic Center for the recorded document specific to your parcel.

  • Do I need approval before building?

    Yes. Plans must be submitted in duplicate to the Association for approval before any construction, including excavation.

  • Can I remove a tree on my lot?

    Not without prior written Association consent - this applies to cutting, trimming or removal on public or private land.
